TERMS & CONDITIONS

Here you will find the Terms and Conditions (T&C) that apply to the Strong Viking Obstacle Runs and associated activities.

Article 1: Definitions

1.1 In these Terms and Conditions, the following terms have the meanings stated below:

  • Event: the event and all activities organized by Strong Viking.
  • Participant: a natural person who, either directly or via a Participating Company, has registered for the Event in an approved manner by the Organizer.
  • Visitor: a natural person who attends the Event in an approved manner by the Organizer, without being registered as a Participant.
  • Participating Company: an organization or company that, with the Organizer’s permission, has registered one or more Participants for the Event.
  • Agreement: the agreement between the Organizer and a Participant, Visitor, and/or Participating Company, in which it is agreed that the Participant will take part in or the Visitor will have access to the Event.
  • Organizer: the legal entity (in this case, Strong Viking Group B.V.; Strong Viking Deutschland GmbH; hereinafter referred to as Strong Viking) with whom the Participant, Participating Company, and/or Visitor has entered into an Agreement.

1.2 These terms and conditions apply to every Agreement. Terms and conditions of the Participant, Participating Company, and/or Visitor are explicitly not accepted.

Article 2: Participation

2.1 The Participant may only participate in the Event if they have completed the registration form fully and truthfully, have paid the registration fee in full through the payment methods offered by the Organizer, and have agreed to the terms and conditions.

2.2 Participation in the Event is personal and must be executed by the Participant themselves.

2.3 The Participant must meet the minimum age requirement set by the Organizer on the day of the Event or must reach this age within the same calendar year:

  • 4 km – Family Run: at least 5 years old
  • 4 km – Beginning: at least 12 years old
  • 7 km: at least 13 years old
  • 13 km: at least 14 years old
  • 19 km & OCR Series: at least 16 years old
  • 42 km Iron Viking & 60 km Ultra Viking: at least 18 years old

2.4 The Organizer has the right to ask for the Participant’s age and/or start number before or during the Event. If it is found that the Participant does not meet the minimum age requirement, the Organizer reserves the right to exclude the Participant from the course.

2.5 The Participant may transfer their rights under the Agreement to third parties, but only using the form provided by the Organizer, which can be found at www.strongviking.com. The transfer must be requested no later than three days before the Event and is not possible to another Strong Viking event. If there are issues with an online purchase, the Participant can contact the Online Dispute Resolution (ODR).

2.6 Refunds for registration fees are not possible if the Participant or Participating Company cancels participation.

2.7 The Organizer reserves the right to cancel, end early, modify (e.g., adjust the course or start times), or move the Event to another date and/or location due to exceptional circumstances such as force majeure. The Organizer accepts no liability for any costs incurred by the Participant.

2.8 If the Organizer decides to cancel, suspend, modify, or move the Event to another date and/or location, the Organizer is not liable for any costs incurred by the Participant and/or Visitor in connection with the Event, regardless of the nature of these costs.

2.9 Participants must always follow the instructions of the Event staff and volunteers. In case of repeated violations, the Organizer reserves the right to terminate participation in the Event without refunding the registration fee or other costs.

2.10 Participating Companies can be:

a) Public law entities
Organizations that fall under public law rules as described in Article 2:1 of the Civil Code.

b) Legal entities
Companies that have been registered with the Dutch Chamber of Commerce for more than six months before the Event.

c) Enterprises without legal personality
Enterprises without legal personality that have been registered with the Dutch Chamber of Commerce for more than six months before the Event.

2.11 The Participant agrees not to perform any business activities on behalf of the Organizer without explicit written consent from the Organizer.

2.12 The Participant is prohibited from wearing shoes with studs/spikes.

2.13 The Organizer may set “cut-off” times for safety reasons. Participants must walk a shorter distance or be escorted directly to the finish line if they exceed this time. The standard running speed is 4 km/h.

  • Max 4 hours for the first 13 km of the 19 km course.
  • Max 2 hours for the first 7 km of the 13 km course.

The Organizer is not liable for damages if this is applied.

2.14 The Participant is responsible for safely and responsibly overcoming obstacles:

  • Swimming skills are required for water obstacles.
  • Participants with pacemakers or heart support devices may not participate in obstacles with electricity.
  • The Participant may always skip an obstacle.

Article 3: Legal Rights and Liability

3.1 Participation in and/or attendance at the Event is at your own risk. The Organizer is not responsible for any damage, regardless of the cause, that you, as a Participant, Participating Company, or Visitor, may experience during the Event.

The Organizer is also not responsible for loss, theft, damage to property, or other forms of damage to the Participant, Participating Company, Visitor, third parties, or other involved individuals, unless the damage is a direct result of intent or gross negligence by the Organizer. This also applies to severe damages such as injury, illness, or death resulting from participation in the Event.

3.2 The Participant must be sufficiently insured against risks, such as injury, illness, or death, that may arise from participation in the event, both for themselves and their loved ones.

3.3 If, despite the first paragraph of this Article 3, the Organizer is held liable for damage to the Participant, Participating Company, and/or Visitor, the compensation will always be limited to the maximum amount that the Organizer’s insurer will pay out in that case.

3.4 The Participant declares that their participation requires good physical and mental health and affirms that they meet these requirements and are sufficiently prepared for the event through training and other activities.

3.5 The Participant acknowledges the exclusion of liability of the Organizer for damage that third parties may suffer as a result of the Participant’s participation in the Event.

3.6 The Participant must have adequate liability insurance.

3.7 The Participant is also aware that large parts of the course go through the forest, over uneven paths, and/or other remote areas, so there is an increased risk of injury caused by slippery surfaces, protruding roots, branches, or other natural objects, for which the Organizer is not liable.

Article 4: Use of Image and Sound Material / Portrait and Image Rights

4.1. By participating in the event, the participant, the participating company, and/or the visitor agree to the following:

  • The Organizer and/or third parties may make and use image and sound recordings, including broadcasts, distribution, and other forms of public display through all existing or new media and technologies.
  • This use is worldwide, for an indefinite period, and without any compensation.
  • The participant and/or visitor waive liability for any consequences of this use.
  • The participant and/or visitor waive portrait and other rights if they appear recognizably in image and sound recordings of the event.
  • Video surveillance by the Organizer for safety and public order purposes is possible.

4.2. The participant, the participating company, and/or the visitor give the Organizer permission to use and distribute image and sound material (such as photos and recordings) on which they are visible and/or audible and which was made during or around the event, for all types of communication and advertising purposes. This is done free of charge.

4.3. If image and sound recordings have been made by the participant, the participating company, and/or the visitor, all rights (such as copyright) remain with the Organizer. They will cooperate free of charge if necessary for the transfer or granting of rights. The Organizer may use this material in any way.

4.4. The Organizer reserves the right to use and publish photos and image material made by the participant during the event in all media without needing to refer to the owner or source.

Article 5: Processing of Personal Data

5.1 The personal data provided by a Participant and/or Participating Company will be stored by the Organizer in a secure file. By participating in and/or registering for an Event, the Participant and/or Participating Company hereby grant permission to the Organizer for the processing and use of this personal data.

5.2 Use of Data
The personal data will be used for the execution of the Event, communication about the Event, and any marketing of similar events by the Organizer to the Participant and/or the Participating Company, and for the execution of the Agreement.

5.3 Consent for Third Parties
The Organizer will only share personal data with third parties when necessary for the execution of the Event or to comply with legal obligations. This will be done in accordance with the GDPR regulations. If consent is given on the registration form, personal data may be shared with third parties for:

  • Sending information to the Participant and/or the Participating Company
  • The execution of the Agreement
  • Photo and time registration, including publication and reproduction of name, image, and race results

5.4 Consent for Publication and Marketing Purposes
The Participant hereby grants the Organizer permission to publish and reproduce their name, race results, and image material for promotional purposes. This use may include publication in photos, videos, posters, newspapers, or online publications, including social media and websites.

5.5 Privacy Statement
For the processing of personal data by or on behalf of the Organizer, the provisions of the Privacy Statement also apply.

Article 6: Advertising and Activations

6.1 It is prohibited to organize promotional activities during, before, or after the event without written permission from the Organizer and/or the Event.

6.2 In the week before the event, during the event, and in the week after, it is not allowed to place signs, banners, flyers, sampling teams, or other promotional materials on or around the festival site and/or the site/track.

6.3 In case of violation, immediate removal will be required, a fine imposed, and any costs and other damage will be charged to the responsible organization or individual.

6.4 Permission for promotional activities or activation purposes can be requested by sending a request to organisatie@strongviking.com.

6.5 The Organizer and/or the event confirms permission only by email. This confirmation must be brought by the organization or individual carrying out the activity to the Event and shown upon request to the Organizer and/or cooperating parties.

Article 7: Prizes

7.1 All prices for Strong Viking are in euros, including VAT and all costs associated with the agreement.

7.2 Shipping costs are not included in the price unless otherwise stated.

7.3 If costs change after the agreement is made (e.g., due to changed taxes or raw material prices), Strong Viking reserves the right to adjust the prices. If the price changes by more than 10%, cancellation of the agreement is possible. This must be done in writing within seven days after receiving the change. In this case, there is no right to compensation.

7.4 If a price is incorrect (e.g., due to an unrealistic offer), Strong Viking reserves the right to calculate the correct price. In this case, it is possible to cancel the purchase within 14 days, provided the product has not been used.

Article 8: Payment

8.1. Payment for orders via the website must be made using the payment methods listed on the website. When paying with an external credit card or electronic payment method, the terms of the bank or card issuer apply.

8.2. Payment by invoice is only possible if agreed upon in writing. In that case, payment must be made within 14 days of the invoice date.

8.3. If the payment term is exceeded, the other party is automatically in default, regardless of the cause of the delay. No formal notice is required. From that moment, Strong Viking reserves the right to charge statutory interest on the outstanding amount, calculated from the due date.

8.4. All costs related to disputes, including legal costs and costs for extrajudicial procedures, are at the expense of the other party.

8.5. If there are multiple outstanding amounts, a payment will be used for the oldest outstanding debt, including interest and additional costs, even if otherwise indicated by the other party.
